§ 250-38. Emergency no parking.

  • A. 
    Whenever road conditions in the Village of Cedarhurst shall become hazardous or such that free movement of fire, health, police, emergency or other vehicular traffic may be impeded by reason of snow, freezing rain, sleet, ice, water, debris, fire or other natural or artificial causes, the Mayor or, in his or her absence, the Deputy Mayor of the Village of Cedarhurst or such other person designated by the Mayor may and is hereby authorized to declare the existence of an emergency.
    B. 
    Notice of emergency.
    (1) 
    The declaration of an emergency as aforesaid may be conveyed to the public by radio or newspaper; announcement by one radio station or one daily newspaper sold locally. Notice may also be transmitted to the general public by distribution of notices, leaflets, handbills or other written or printed notices distributed to the general public or affixed to the automobiles parked on the streets within the Village of Cedarhurst. Notice shall also be given by sounding the fire whistles and horns as follows:
    (a) 
    For declaration of emergency: six blasts.
    (b) 
    For termination of emergency: eight blasts.
    (2) 
    Notice when given as aforesaid shall constitute due and proper notice; however, if the emergency is obvious, such as fire, unusually heavy snowfall or other visible causes, which to a reasonably prudent person would indicate the presence of an emergency, no additional notice shall be required.
    C. 
    The emergency so declared shall be deemed to continue for a period of 72 hours unless terminated earlier by the person designated in Subsection A of this section.
    D. 
    It is ordered and directed that the streets or parts of streets described in Schedule XX (§ 250-74), attached to and made a part of this chapter, are hereby designated as emergency no-parking zones, and signs shall be posted on said streets or parts of streets. In addition, all municipal parking lots are also designated emergency no-parking zones, and signs shall be posted in said lots.
    E. 
    Any unoccupied vehicle parked or standing in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and the Commissioner of Public Works and/or any police officer may provide for the removal of such vehicle as provided in Article IV of this chapter.
    F. 
    The provisions of this section shall not apply to physicians on emergency call, authorized emergency vehicles as defined in the New York State Vehicle and Traffic Law, and/or snow-control vehicles.
