§ 238-7. Towing away vehicles involved in accidents.

  • It shall be unlawful to tow away any vehicle which has been involved in an accident without the prior consent of the owner or operator of the vehicle and, if there be a police officer at the scene of the accident, without the consent of the police officer also, except that no vehicle shall be removed where the police officer requires that an examination be held for the purpose of determining whether or not the vehicle is defective.
